Donald Trump’s tariffs have been making headlines for months.
But now, a U.S. court has ruled them “unconstitutional” and illegal.
The decision sent the president into a fury.
For months, Donald Trump’s presidency has been defined by tariffs.
Branded as “reciprocal tariffs,” the policy was rolled out on what Trump called “Liberation Day” back in April — and it’s shaken global trade ever since.
But now, a major blow has landed. The U.S. Court of Appeals ruled that Trump did not have the legal authority to declare national emergencies and unilaterally impose tariffs on countries around the world.
In a 7–4 decision, the Court of Appeals sided with the U.S. trade court, which had already struck down the tariffs back in May. However, the appeals court gave the administration room to take its fight to the Supreme Court — meaning the tariffs remain in place for now.
The tariffs the Trump administration slapped on specific industries – like cars, steel, and aluminum – aren’t part of Friday’s court ruling. Instead, the decision targeted Trump’s sweeping tariffs applied to nearly every country, which he justified by pointing to America’s massive trade deficit in goods.
A court ruling that the Trump administration’s trade tariffs are unlawful amounts to a sharp legal rebuke of the U.S. president. But Trump wasted no time firing back.
In a fiery Truth Social post, he wrote:
“ALL TARIFFS ARE STILL IN EFFECT! Today a Highly Partisan Appeals Court incorrectly said that our Tariffs should be removed, but they know the United States of America will win in the end. If these Tariffs ever went away, it would be a total disaster for the Country. It would make us financially weak, and we have to be strong.”
The president doubled down, warning that the ruling could “literally destroy” America if allowed to stand. He insisted tariffs are his best weapon to defend American workers and slammed politicians of the past for letting foreign nations walk all over U.S. industry.
“At the start of this Labor Day weekend, we should all remember that TARIFFS are the best tool to help our Workers, and support Companies that produce great MADE IN AMERICA products,” Trump wrote. “Now, with the help of the United States Supreme Court, we will use them to the benefit of our Nation, and Make America Rich, Strong, and Powerful Again!”
But critics warn the ruling could have massive financial implications — including forcing the Trump administration to refund billions in tariffs already collected.
Meanwhile, global markets remain on edge, with fears that U.S. consumers could face higher prices on everyday goods if the trade war drags on.
